Terms and Conditions

 

1 PRODUCT

1.2 Flowers are a perishable, seasonal agricultural products based on market availability. Photos on our website are examples of style,size, and colour palette, and not exact blueprints. You can contact Flowers by Martine for further information on your order or fill out the contact us form on the website.

1.3 To increase vase life some arrangements may be delivered in bud.

1.4 Some products will be subject to availability during peak periods.

1.5 We reserve the right to substitute flower varieties,colours,and containers of equal or greater value without prior notice or refund liability.We will endeavour to contact you should this occur with no compromise on quality. If we are unable to carry out a required arrangement we will contact you. 

1.6 Local delivery. (See charges in delivery 4.1)

 

2 PRICES

2.1 Prices are valid for a maximum of 3 days after placing your order.

2.2 Prices are subject to change during peak periods.

2.3 Prices for delivery are not included in product price. Please see delivery information (4)

2.4 We reserve the right to change prices on any of the products at the Flowers by Martine online website.

 

3 ORDERS & PAYMENTS

3.1 In order to fulfil your order payment must be paid in full when placing order prior to construction and delivery of your flowers (this applies to all event floral displays) you will then receive email confirmation of your payment.

3.2 You will be required to provide personal details, these include:

Postcode.

Addresses.

Telephone numbers.

Names of you and recipient.

Accurate access codes,gate keys,or business hours

Payment details.

3.3 Payment accepted by most major credit/debit cards and unless otherwise stated at time of order.

Bank Transfer: Details available on request.

 

4 DELIVERY & CHARGES

4.1 Delivery charges apply in the specified area.

4.2 Local delivery will be £6.00  within a 3 mile radius, delivery charge of 75p per mile thereafter.

Deliveries for event florals are subject to individual charges and will be priced along with the initial pricing summary.

4.3 Delivery to remote areas or to those that are not within the local area will be advised of additional delivery charges,if this is too far out of the area then collection would be advised.

4.4 Requesting delivery for set time cannot be guaranteed but we will endeavour to honour such requests where possible, this can be discussed prior to delivery and a schedule put in place.

4.5 All Flowers are made to order to keep quality and freshness our priority, and to minimise waste.

Same day delivery is not available at present,but subject to future changes.

Flowers ordered before 10am are available for next day delivery after 12pm.

4.6 We do not deliver on Sunday and public holidays. In some circumstance’s exceptions can be made prior to discussion.

4.7 Please ensure recipients full name and address with correct postcode are included with your order along with your telephone and email, the customer must provide accurate access codes,gate keys,and business hours, designated safe place to leave the flowers if the recipient is not home, they will be left in the safe place provided or with a neighbour.

Flowers by Martine holds zero liability for flowers that are stolen,damaged by pets,or ruined by extreme heat,frost, or rain after the delivery is made, please insure instructions are accurate at time of order.

Whilst every effort will be made to ensure the delivery is met,if a secure drop off is impossible (eg:locked gate,apartment block,lobby) and the flowers must return to the studio,a redelivery fee will be charged for a second attempt.

4.8 Delivery to Hospitals, Schools, Offices etc where a third party is involved during receipt of flowers. Signatures of authorised personnel will be needed to except delivery on behalf of the establishment. This person will sign for receipt of goods therefore this needs to be clearly stated when placing the order for this kind of arrangement including any extensions.

 

5 CANCELLATIONS

5.1 Orders can be cancelled or amended 24 hours before delivery date,a credit note will be given for future order. Subscription flowers require 5 business days prior to your scheduled billing date. Subscription flowers are custom,perishable items and are exempt from standard refund laws.

5.2 FLOWER CARE

Flowers are highly perishable,your flowers will arrive with a care card, and any additional information if needed.

Customer flower care includes: re-cutting stems,clean vase and water, flower food provided, keep away from direct heat,draugh's,fruit bowls,pets and children.

Any quality issues must be reported with photographic evidence within 24 to 48 hours of delivery.If the basic care instructions were followed then a partial refund may be permitted.

6 GENERAL

6.1 We reserve the right to supplement and amend the Terms & Conditions to Flowers by Martine website from time to time changes will be posted and it is your responsibility as the customer to review Terms & Conditions on each occasion you visit the website.

6.2 We reserve the right to suspend,restrict or terminate access to Flowers by Martine online services.

6.3 Beyond reasonable control of Flowers by Martine anything that affected the performance of our obligations under these Terms and Conditions and could not reasonably be foreseen or provided against- for clarity this includes any Pandemic or Epidemic- which would impact the ability for Flowers by Martine to complete obligations within these terms & Conditions and  would be out of our control & closure of the services would be essential due to the safety of the customer and our business

6.4 We shall ensure that we comply with current Data Protection Act and legislation. We will only use personal information given by you for the purpose of fulfilling our obligations under the Terms & Conditions we have set out at Flowers by Martine.

 Any person who is not party to the agreement between Flowers by Martine has no right to enforce the Terms & Conditions,

 

 

7 PRIVACY STATEMENT

7.1 At Flower by Martine we are committed to protecting our customer privacy. Customers and recipient’s personal information is considered confidential and therefore shall not be used or shared with any third party.
